How can you help with comments on the
Council of Affordable Housing’s Proposed Rules?

COAH’s Process for filing comments on the Proposed Rules

All comments should be identified by the applicable N.J.A.C. citation and submitted in the following format:

Format example: “5:94-1.3. Comment: The definition of household should be changed to delete the reference to persons under age 18.” This may be followed with any supporting reasons, references, and any other additional information that the commenter wishes to supply.

The Council encourages comments to be submitted in electronic form to: coahmail@dca.state.nj.us to enable an expeditious review and response. Such comments should include the words “Rule Comments” in the subject box. The Council will also accept written comments sent via mail and or fax at
(609) 633-6056, but requests a follow-up PC-formatted disk in Microsoft Word to be delivered as soon as possible thereafter to enable comments to be processed electronically. Fax copies shall also be followed by a mailed copy if a disk is not possible.

Rule Comments to NJAC 5:94

“5:94 Appendix D Use Group “S” Storage uses. This section includes warehouses. It is proposed that the job generation ratio be 1.5 per 1,000 square feet.

Comment: The COAH job generation ratio for warehouses has increased 750 per cent over the ratios that COAH adopted in 2004. The job numbers far exceed the actual number of jobs that Cranbury Township’s own research shows are created by the warehouses in the Township.

Comment: If this change (from the 2004 adopted rules) in the job generation ratios is left as proposed, Cranbury Township will face a retroactive obligation of 469 units, which is a 1,072 percent increase, just to address warehouse development that already has approvals. This equates to half, or fifty per cent of the total housing constructed to date in Cranbury Township. The retroactive obligation related to warehousing equates to sixty-eight million dollars in construction costs alone. The retroactivity related to warehouses approved up until June 1, 2008 should be removed.
