The TC is adopting the changes at their next meeting so if people really care about zoning changes not being allowed that is the time to comment.

The waiver was for the design of the light pole bases, not the lighting itself.

From the Zoning Board minutes...

It appears the Dunkin Donuts qualified for a waiver for lighting, which fortunately will only have an impact during hours of operation...
...which could be up to 24 hours per day.

Well. It was all published on an agenda, heard by the zoning board, approved by the zoning board and no one showed up opposing. Further a member of the zoning board lives in the Estates.

You can't say no one in the Estates knew the few people I know who live there all said they are fine with it.

There are no residents in the estates that like the idea of a Dunkin' Donuts. Whoever posted that is a liar.

There is a town email system letting people know when agendas and minutes are posted. It's an easy sign up.

I live in the estates and it's the first I've heard about it -- talked to a few neighbors -- I guess I don mind as long as it's not open really early in the morning or late at night

The TC and PB took no leverage away from the Zoning Board as it pertains to the Dunkin Donuts.

The ZB approved the Dunkin Donuts and granted a variance before the changes were made to the Master Plan.

All the TC and Planning Board did was revise the Master Plan based on the Zoning Board's actions. And as was noted there was no public opposition to the application so raising it now and blaming the TC and PB is non-sensical.

Besides, at the time of adoption of the Master Plan it was stated that the business element was going to be under refinement.

Yes. Thats the point. If you change the master plan you take away the leverage of the township (zoning board).

Heres an example...

Dunkin Donuts wants a drive through. The Master Plan does not allow for it. Dunkin Donuts requests a variance. The zoning board approves the variance provided Dunkin Donuts agrees to limit operating hours and to use one of the building designs Dunkin Donuts uses in nicer communities, like Cranbury.

Or

Dunkin Donuts wants a drive through. The township re-writes the master plan over the summer to allow for a drive through without a variance. The township asks Dunkin Donuts to limit hours and use a pleasant building design. Dunkin Donuts tells the township to pound sand.

When no one goes to a meeting despite all the notice and discussion there really isn't a point to complain.

The purpose of the zoning board is to consider applications that fall outside of Master Plan elements. No one came and complained to the meeting. In fact, the opposite was true based on what I hear in town.

Oh yes we "Should" be able to TRUST our boards and committees to follow the Master Plan, but there are some of those folks who make their own rules depending on the applicant and what suits their needs of the moment. Rateables are nice; but not at any cost. Someday the voters will realize that a change of leadership is due in order to change the powers that be, along with their appointed board favorites that vote as they are told.

Dunkin Donuts went before the zoning board before this change was made.

The Master Plan was also adopted knowing that the business issues on 130 would need clarification. There were multiple hearings on this change.

That's all fine and good. I agree that before you complain online you should attend the meetings and follow the process. However, I attended a bunch of meetings about the master plan, along with a lot of other people. The plan was supposed to be good for 10 years and it specifically did not allow for stuff like this without requiring variances (which gives the town leverage). Now, just a few years into the plan, a few people decide to rewrite the plan specifically for this project because someone is dangling donut money in front of us. That's not how a master plan is supposed to work. We should be able to trust that our boards and committees will follow the master plan and not look to change it every couple of years to accommodate one-off requests.

It will be a burden for those who live in the estates. Noise, light pollution, etc.. Eventually will attempt to keep it open 24-7 like his other route 130 stores.
