Post subject: Ridiculous: Builder's Remedy Lawsuit Filed Against Cranford
It is being reported (

) that Cranford is being sued for the second time this year through a builders remedy law suit.
In the article the following is said about Crawford’s dilemma...
"Cranford has failed to create sufficient realistic opportunities for the construction of safe, decent housing affordable to low and moderate income households"
"The suit makes specific mention of the Mt. Laurel decision, a landmark case that found municipalities in New Jersey responsible for providing affordable housing for low and moderate income individuals. By filing an affordable housing plan with the Council on Affordable Housing (COAH), the state office responsible for determining affordable housing requirements, towns can protect themselves against builder's remedy lawsuits."
A builders remedy is just another aspect of what is wrong with the affordable housing rules and regulations here in New Jersey.
Because these law suites are used by builders to force towns to build unneeded housing under the guise of providing affordable housing for those that need it most when in reality the builders are only interested in building large amounts of market rates homes for profit.
Law suites such as these highlight why we don't need to tweak the affordable housing rules and regulations in New Jersey. It is a reason why we need to do away with these rules and regulations through legislation.
