Notice the language... it says take action or process to implement. It does not say that towns due to file such as Cranbury are allowed to withhold their planning and I could see a court saying Cranbury did not submit and therefore regardless of what was happening with COAH the town is now liable to a builders remedy. Considering the risk of a builders Remedy, I hope the TC is making sure that if we decide not to file in March that we are protected and I would hope that the TC gets a letter from COAH or another formal state entity to that effect even if COAH were to disband.

Post subject: Governor Christie Signs Executive Order on COAH

Today, the Governor signed an Executive Order implementing a 90-day period in which,
“COAH shall refrain from taking any further action to process applications for substantive certification or to take any other actions to implement the Third Round Regulations.”
Further, the Executive Order creates the “Housing Opportunity Task Force” to undertake a review of the Fair Housing Act, the State Planning Act and COAH regulations. This task force will be chaired by former State Senator Marcia Karrow.
